Trademarks How does a trademark differ from a Patent? A trademark protects a company's right to use a mark (words or image) which is unique in identifying the source of the products or service. The philosophy behind trademarks is to protect the public by making it easy to identify the source of a product or service. For this reason a trademark will only be granted on a specific category of products or service, and only if it is not likely that a trademark will be confused with existing trademarks.
