Patents
  •  Patentability Opinion
Is my idea eligible for a patent?  To determine if a new product or method is
patentable a search of prior patents and publications is conducted in the
United States Patent and Trademark Office.  The results are analyzed according
to current patent law to determine if the invention is likely to receive protection
under a patent in the United States.  Final determination of patentability, however,
can only be determined by the United States Patent and Trademark Office after a
patent application is filed.    Wayne Carroll has advised many clients on the likely
success of a patent application.

  •  Patent Drafting
Is it easy to write a patent?  Patent law is very complex, and there
are many pitfalls.  Anyone can write a patent, but not anyone can obtain
a strong patent.   Wayne Carroll has drafted patents for clients of all types in
including Fortune 500 companies, and individual inventors.

  •  Patent Filing
Are there special rules for filing a patent?  Yes.  When a patent is
filed there are many rules on the format and content of the patent.   Wayne Carroll

Copyrights
  •  Filing Copyrights
How do I file a copyright?  Information is available at the Official
Copyright Office Website.
Trademarks
  •  Filing Trademarks
How does a trademark differ from a Patent?  A trademark protects a company's
right to use a mark (words or image) which is unique in identifying the source of
the products or service.  The philosophy behind trademarks is to protect the
public by making it easy to identify the source of a product or service.  For this
reason a trademark will only be granted on a specific category of products or
service, and only if it is not likely that a trademark will be confused with existing
trademarks.  To request more information on obtaining federal trademark
protection please see the
Contact Us page.
Trade Secrets
What is a trade secret?  A trade secret is a property right that a company has in
information which is kept secret, and has value as long as it is kept secret.  A
secret recipe that is used in business is an easy example of a trade secret.  If a
trade secret plan is not set up and executed properly, a remedy in court may not
be available if the secret is stolen or unlawfully disclosed.    To request more
information on assistance in developing a trade secret plan please see the
Contact Us page.  Wayne Carroll will help you establish and maintain an internal
trade secret plan to protect you companies valuable assets.
